Justice still prevails in Allahabad High Court, kudos to Court

It was on
last Friday, a rare and a great opportunity came to me, when I was able to
witness the largest bench of Allahabad High Court. The seven Judges bench,
headed by the Chief Justice D.Y. Chandrachud and comprising of other six judges
like, Justice Rakesh Tiwari, Justice V.K. Shukla, Justice Tarun Agarwal,
Justice Arun Tandon, Justice Dilip Gupta and Justice A. P. Sahi, was
constituted for hearing some important and vital cases, related to various
causes.
While during
the proceeding of the larger bench, the entire court (including judges) was
surcharged with emotion, when a emotionally shattered woman stood before the
bench to narrate her owes, related with the arrest of her husband and Sub Inspector
(SI), Mr. Sailendra Singh, who was being arrested due to the firing from his service
revolver, in the Civil Court of Allahabad, which may have happened due to scuffle
with a advocate, Mr. Nabi Ahmed, who died on spot, due to firing, on last
March.
The wife of
the SI, Mrs. Sapna Singh, with her emotionally choked voice, told the court
that she have approached the Session Court, thrice, for the bail application of
her husband, who is languishing in the jail, since from the month of March, but
every time, many unruly and hooligan advocates not only manhandled her, before
entering the court, but also hurled abusive languages to her, they even
snatched the bail application and tore it, before her.
When the
court asked whether she had any advocate for assisting her, in the civil Court,
she told that not a single advocate of Allahabad were being allowed to handle
her case and she also appraised the court that she is fighting alone for
pursuing this case, but due to unwanted physical hindrance, created by the
advocates of the Civil Court, she could not even file a single bail
application, so far.
After
hearing the woes of the sad lady, the court have expressed their ire and
scolded the Advocate General for declining of the law and order of the state,
the court also rebuke some couple of lawyers, who were opposing the application
of Mrs. Singh.
The court
immediately came in conclusion on the application (not a petition) of Mrs.
Singh, who herself have pleaded before the seven bench court, without hiring
any counselor for her support. The court has made a unanimous order to the
District Court of Allahabad to hand over the entire file of the case to the
District Court of Raibarely, within 48 hours of this order.
I was really
overwhelmed to observe the softly spoken style of pleading of the brave heart
lady, before the larger bench and also feel delighted to see that the hon’ble
court decided a case, on a simple application of Mrs. Singh and kudos to Allahabad
High Court, Who keeps big heart and mind, while delivering the verdict.
